SQUIBBER TERMS OF SERVICE

RECITALS

WHEREAS, Squibber provides a verified, college student-focused subleasing marketplace platform for connecting student renters ("Subletters") and student tenants seeking to sublease their rooms ("Hosts");

WHEREAS, Squibber facilitates, but is not a party to, sublease agreements between Hosts and Subletters and provides administrative services such as identity verification, deposit escrow, document execution, and payment processing;

NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties agree as follows:

1. ELIGIBILITY

  • 1.1 You must be at least eighteen (18) years of age and currently enrolled in or recently graduated from a higher education institution with a valid .edu email address.
  • 1.2 You represent and warrant that all information provided to the Platform is truthful, accurate, and complete, and you agree to update it promptly if changes occur.

2. ACCOUNT CREATION & VERIFICATION

  • 2.1 Users must register an account to access certain features. Squibber may require verification through government-issued identification, a .edu email address, and housing documentation.
  • 2.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.

3. PLATFORM ROLE AND LIMITATION

  • 3.1 Squibber is not a landlord, property manager, or real estate broker.
  • 3.2 Squibber does not own or control the premises listed on its Platform.
  • 3.3 The Platform acts solely as a neutral venue for matching users and administering payments, digital agreements, and deposit holdings.

4. SUBLEASE AGREEMENTS

  • 4.1 All Subletters and Hosts must enter into a digital Sublease Agreement provided by the Platform.
  • 4.2 Squibber uses a SOC 2-compliant, GDPR-ready digital signature service to execute such agreements, which are legally binding on the parties.
  • 4.3 The sublease relationship is solely between Host and Subletter. Squibber is not a party to the agreement and does not mediate disputes beyond providing limited administrative support.

5. FEES, DEPOSITS, AND PAYMENTS

  • 5.1 All Users agree to process all payments exclusively through Squibber's designated systems and payment providers.
  • 5.2 Subletters must pay all rent and any applicable service deposits through the Platform.
  • 5.3 Hosts must receive payouts through the Platform. Off-platform transactions are strictly prohibited and may result in account termination.
  • 5.4 A deposit equal to one month's rent may be collected and held in escrow by Squibber. This deposit is returned after the sublease ends, subject to any deductions authorized by both parties.
  • 5.5 Squibber may pass third-party payment processing fees (e.g., Stripe fees) to users as part of the total transaction cost.
  • 5.6 Any interest accrued on held deposits may be retained by Squibber.

6. CANCELLATIONS AND REFUNDS

  • 6.1 Unless otherwise stated in the listing or agreement: (a) Full refund if canceled 14+ days before the start date (less processing fees); (b) Partial or no refund within 14 days of the start date; (c) Host cancellations post-booking may result in penalties and potential account suspension.
  • 6.2 Refunds are not guaranteed and may be issued at Squibber's sole discretion.

7. PROHIBITED CONDUCT

7.1 Users may not:

  • Falsify identity or documents;
  • Circumvent the Platform's payment or messaging system;
  • Discriminate on the basis of race, religion, gender, disability, or other protected class;
  • Use Squibber to facilitate illegal, dangerous, or fraudulent activities;
  • Create nuisances, unsafe conditions, or harass others.

8. REVIEWS AND RATINGS

  • 8.1 Users may submit reviews and ratings post-sublease.
  • 8.2 Squibber reserves the right to remove content that is false, discriminatory, or in violation of our community standards.

9. LIABILITY WAIVER

  • 9.1 You use the Platform at your own risk.
  • 9.2 Squibber disclaims all warranties and is not liable for:
    • The condition or legality of listed spaces;
    • Acts or omissions of Hosts or Subletters;
    • Damages, theft, or personal injury related to a sublease;
    • Technical interruptions or data loss.

10. INDEMNIFICATION

  • 10.1 You agree to indemnify and hold harmless Squibber, its affiliates, and employees from any claims or damages resulting from:
    • Breach of these Terms;
    • Violation of any laws;
    • Misconduct or negligence in your use of the Platform.

11. TERMINATION

  • 11.1 Squibber may suspend or terminate your account at its discretion for any breach of this Agreement.
  • 11.2 You may deactivate your account at any time; obligations under active agreements will remain enforceable.

12. PRIVACY

  • 12.1 Squibber's Privacy Policy explains how we collect, use, and share data. By using the Platform, you consent to those practices.

13. GOVERNING LAW

  • 13.1 This Agreement is governed by the laws of the Commonwealth of Massachusetts.
  • 13.2 Any disputes shall be brought in the state or federal courts located in Suffolk County, Massachusetts.

14. ENTIRE AGREEMENT

  • 14.1 This Agreement, along with the Privacy Policy and executed Sublease Agreements, constitutes the entire understanding between you and Squibber.
  • 14.2 No waiver or modification shall be valid unless in writing and signed by both parties.

15. FACE USE FOR ADVERTISEMENT

  • 15.1 You agree to allow Squibber to use the following assets and information for advertisement purposes: your face, your university, and your room photos.

IN WITNESS WHEREOF, by using the Platform, you affirm your consent to be bound by the above terms.
